“Health Facility and Services Development Act,” makes it illegal to undertake a project subject to the act without obtaining a valid certificate of need through a regulatory process with the state agency. A Certificate of Need ensures there is a genuine public need for the expanded capacity, but also can be anticompetitive by creating barriers to entry for new market-entrants.
