The Commissioner shall consider each proposed increase or decrease in the rate of any kind or line of insurance or subdivision thereof. All rates for health benefit plans available for purchase by individuals and small employers are considered proprietary and constitute trade secrets, and are not subject to disclosure by the Commissioner to persons outside the Division except as agreed to by the carrier or as ordered by a court of competent jurisdiction.
