States that if an enrollee elects to obtain a covered comparable health care service from an out of network provider at a price that is the same or less than the statewide average for the service based on data reported publicly on the health care cost website, the carrier shall allow the enrollee to obtain the service from the out of network provider at the provider’s charge and shall apply the enrollees payments toward the enrollees deductible and out of pocket maximum, as if it were provided by an in network provider.
