Providers may not make referrals to an entity in which the provider or a family member owns an interest. Payment models will be assessed by the insurance commissioner for compliance. Except as provided in subsection (c) of this section and Title 12 of this article, a health care practitioner making a lawful referral shall disclose the existence of the beneficial interest in accordance with provisions of this section. Practioners shall disclose the name of a referring health care practitioner on each request for payment or bill submitted to a third party payor, that may be responsible for payment, if the health care practitioner knows or has reason to believe there has been a referral made by a practitioner who has a beneficial interest or compensation arrangement.
