Statutes authorize the commissioner to arrange a conference to determine if an HMO has violated this chapter, and if a violation has occurred, the commissioner can determine an adequate and effective means of correcting or preventing the violation. The commissioner may augment a penalty that he or she calculates to be the damages suffered by enrollees or other members of the public. See definition section Ind. Code §§ 27-13-1-1 through 27-13-1-34.
