An Act Protecting Patients And Prohibiting Unnecessary Health Care Costs. Prohibits all-or-nothing clauses, anti-steering clauses, anti-tiering clauses, and gag clauses in contracts entered or renewed by a health care provider, carrier, or plan administrator. Requires that health carriers disclose how they select providers for different tiers and evaluate providers within each tier. Eliminates certificate of need for certain imaging equipment, certain linear accelerators, and certain replacement scanners; requires Office of Health Strategy (OHS) to issue a certificate of need determination letter within thirty days of receipt; requires certificate of need applicants to post notice of an application in two community sites and the applicant’s website; requires the OHS to limit requests to an applicant for additional information to two requests and to cease all additional requests not later than six months after receipt of the application; sets time limits for decision making in cases without a public hearing; requires applicants to post notice of a public hearing on the applicant’s website and two community sites; allows for OHS to retain independent consultation from an expert, if necessary and bill the applicant for the expert; and requires OHS to issue determinations on relocations of services within thirty days.
