This bill amends the Health Care Facilities Act to add a new chapter on Health Systems Protection. The key provisions include: – Prohibiting mergers, acquisitions, and other material changes between health systems or provider organizations that are deemed to be against the public interest, except in limited circumstances to prevent a health system’s closure or greater loss of health services. – Requiring health systems and provider organizations to file notifications with the Attorney General and undergo a waiting period before entering into agreements or transactions resulting in material changes. – Granting the Attorney General the authority to review the proposed changes, hold public hearings, and take legal action to enjoin transactions that are against the public interest. – Imposing civil penalties for failure to comply with the notification and information submission requirements. – Allowing the Attorney General to promulgate regulations and contract with experts to assist in the review process, with the costs reimbursed by the transaction parties.
