This bill pertains to amendments in the existing regulations related to the Certificate of Need (CON) in the healthcare sector in the state of Kentucky. The CON is a legal document required in many states, including Kentucky, before the construction of new healthcare facilities or offering new medical services. According to the bill, the Cabinet for Health and Family will conduct public hearings on CON applications upon the applicant’s request. The Cabinet must inform the applicant of their right to request a hearing. Only the applicant can request a public hearing within 15 days of the Cabinet’s decision regarding the application. Notifications about the public hearing and the Cabinet’s decision will be exclusively provided to the applicant. The same restrictions apply when the applicant requests a hearing for the reconsideration of the Cabinet’s decision. Furthermore, the bill modifies the right of appeal to the Franklin Circuit Court regarding any final decision of the cabinet exclusively to the applicant. These changes focus on making the applicant as the primary stakeholder in the application process for Certificates of Need.
