Status: Enacted
Year Enacted: 1982
Year Amended: 1995
File: Download

Statutes state that a Medicare supplement policy shall not exclude or limit benefits for loss incurred more than 6 months from the effective date of coverage because it involved a preexisting condition. Statutes require Commissioner to establish minimum standards for benefits, claims payments, marketing practices and compensation arrangements and reporting practices for Medicare supplement policies and certificates. The statutes promote full and fair disclosure in the sale of Medicare supplement policies by requiring that applicants be provided with an outline of coverage at the time the application is made. The statutes require Medicare supplement policy plans to be made available to applicants under 65 who qualify for Medicare because of a disability, and the issuance, effectiveness or price of the plan cannot be conditioned on the health status of the applicant.
