Ala. Code § 34-24-53.1. Board of Medical Examiners — Rulemaking authority: Physicians and Osteopaths – Alabama

Status: Enacted
Year Enacted: 2016
File: Download

Statute gives the State Board of Medical Examiners and the Medical Licensure Commission the authority to make rules and regulate the practice of medicine. The State Board of Medical Examiners and the Medical Licensure Commission and its members are immunized from state and federal antitrust laws, if they adopt a rule that prioritizes patient safety and wellness. But the exception is not to be construed to expand or constrict anticompetitive conducts beyond those defined by N.C. State Bd. of Dental Examiners v. FTC, 135 S.Ct. 1101 (2015).
