STREAMLINING AND ADDING CRITERIA TO THE CERTIFICATE OF NEED PROCESS BY THE PUBLIC HEALTH AND HEALTH PLANNING COUNCIL: Notwithstanding any other provisions of this chapter to the contrary, the public health and health planning council may approve the establishment of diagnostic or treatment centers to be issued operating certificates for the purpose of providing primary care, as defined by the commissioner in regulations, without regard to the requirements of public need and financial resources as set forth in subdivision three of this section.
