This bill aims to protect health systems by amending the Health Care Facilities Act of July 19, 1979. The bill outlines powers and duties for different healthcare entities including the Department of Health, State Health Coordinating Council, health systems agencies and Health Care Policy Board, among others. It calls for the certification of need for healthcare providers and outlines penalties for violations. The bill also stipulates that no entity shall sell, transfer, lease, exchange or otherwise encumber a significant amount of a health system’s assets or operations if it goes against public interest. However, exceptions might be considered if there are no feasible alternatives to prevent a health system’s closure or severe loss of health services. To ensure compliance, the bill proposes a fine of not less than $10,000 for each day of noncompliance. The bill also gives the Attorney General the authority to form contracts with Federal or Commonwealth agencies and hire experts or consultants necessary for reviewing proposed agreements or transactions.
