Statutes govern the mergers, consolidations and acquisitions of domestic stock insurers and mutual insurers and require a plan and agreement to be filed with the Commissioner which must be approved in writing by the Commissioner. The statutes state that the Commissioner shall give approval within a reasonable time after filing unless the Commissioner finds that the agreement would materially tend to lessen competition in the insurance business or would materially tend to create a monopoly as to such business.
