“States that an individual shall not be prohibited from rendering medical services if received under the supervision of a licensed physician. Reciept of these services do not require a physician’s supervision, unless a physical presence is necessary to provide patient care of the same quality as provided by the physician. Allows the physician to delegate such services to an employee, support staff or program graduate, when appropriate, however nothing is to be construed to apply to registered nurses. Optometry services are an exception.
Osteopathic physicians are not prohibited from delegating to employees certain activities relating to medical care and treatment while under the direct control of the physician; The delegating physician is legally liable for the activities of those individuals; the physician assistant must be licensed by the Board of Osteopathic Licensure. Note: Unlike 32 M.R.S. § 3270-A et seq., the rules for Osteopathic PAs do not specifically mention scope of work, only that they be licensed by the Board.“
