DRUG MANUFACTURER OR WHOLESALE DISTRIBUTOR PROHIBITED FROM PRICE GOUGING:  A manufacturer or wholesale drug distributor may not engage in price gouging in the sale of an essential off-patent or generic drug. A price increase is considered “excessive” if the price increase, by itself or in combination with other price increases, would result in an increase of 50 percent of more, compared to the preceding one-year period, in the wholesale acquisition cost of the drug or other relevant measure of drug cost. It is not a violation of this subdivision for a wholesale drug distributor to increase the price of an essential off-patent or generic drug if the price increase is directly attributable to additional costs for the drug imposed on the wholesale drug distributor by the manufacturer of the drug.
