The Pharmacy Audit Integrity and Transparency Act (website URL still pending), provides that a pharmacy may inform consumers of lower cost alternatives and cost share to assist health care consumers in making informed decisions. It also prohibits pharmacy benefit managers from penalizing a pharmacy for discussing certain information with consumers. Pharmacy benefit managers are also prohibited from collecting cost shares exceeding the total submitted charges by a pharmacy, and pharmacy benefit managers are limited as to when they may charge certain adjudicated claim fees to a pharmacy. Employee benefit plans under the ERISA or Medicare Part D are excluded from this code section.
