A preexisting condition provision in a small or large employer health benefit plan may apply only to coverage for a disease or condition for which medical advice, diagnosis, care, or treatment was recommended or received during the six months before the earlier of: the effective date of coverage; or the first day of the waiting period. See definition section Tex. Ins. Code § 1501.002.
