SB 538 creates the Oklahoma Patient Right to Know Act. The measure authorizes pharmacists to submit a request in writing from a patient for information on the specific allocation of the dollar amount of the retail price provided to the insurer, manufacturer, wholesale drug distributor and
pharmacy benefit manager for the drug or drugs being dispensed. These entities must provide the
information within 30 days of receiving the request. A fine of $50.00 per day shall be levied by the Insurance Department against any entity that does not provide the requested information within 30 days. The Department is directed to deposit the funds collected from the levy into the State Insurance Commissioner Revolving Fund.
