A BILL to amend and reenact §5-16-9 of the Code of West Virginia, 1931, as amended, relating to the Director of the Public Employee Insurance Agency’s authority to execute contracts for group prescription drug insurance; requiring the director to include language in any contract for pharmacy benefits management that requires the quarterly report of certain data relating to payment of claims; requiring any pharmacy benefit manager of the agency to itemize administrative fees, rebates, or processing charges associated with pharmacy claims when there is a difference between the amount paid to a pharmacy provider and the amount charged to the agency; providing that any proprietary data be kept confidential; requiring the director to report aggregated data to the Joint Committee on Government and Finance at least quarterly which details any difference between the amount paid by a pharmacy benefit manager to pharmacy providers and the amount charged to the agency for each claim by the pharmacy benefit manager, and the impact any difference has on agency expenditures; and requiring the director to terminate a pharmacy benefit manager contract for failure to comply.
