This bill amends Kentucky’s laws relating to certificate of need (CON) requirements for health facilities and services, expanding exemptions and modifying notification procedures. Specifically, the bill adds several types of health facilities and services to the list of entities that are exempt from obtaining a certificate of need, including psychiatric hospitals, physical rehabilitation hospitals, chemical dependency programs, hospices, home health agencies, kidney disease treatment centers, and freestanding hemodialysis units. The bill also modifies the definition of “health facility” and “health services” for certain notification requirements, removes some restrictions on service reductions and terminations, and simplifies the process for acquiring or modifying certain health facilities. Additionally, the bill makes technical changes to clarify existing regulations around critical access hospitals and ambulance services, ensuring that more types of healthcare providers can operate with reduced administrative burden while maintaining basic oversight and quality standards. These changes are intended to increase healthcare access and flexibility, particularly in rural areas, by reducing regulatory obstacles for healthcare providers.
