NY’s policy on collaborative agreements between health care providers is to: encourage those that improve quality, outcomes, efficiencies, and access. Such agreements require active oversight by an appropriate commissioner. If an agreement is anticompetitive under state or federal laws, the statute provides a state action immunity to the antitrust laws.

Regulations adopted: 10 NYCRR §§ 83–2.1 through 83-2.16 (effective 2014).
