Currently, utilizing the unanticipated out-of-network process is optional. This bill requires health care professionals to utilize the process outlined in statute for claims for charges for unanticipated out-of-network care. The bill protects patients who receive emergency care at an in network facility from surprise out of network bills. Payer will reimburse out of network provider a reasonable amount. If both sides cannot agree, the bill will go to arbitration. Provider is prohibited from balance billing the patient
