This bill amends Kentucky’s laws regarding certificate of need (CON) requirements for health facilities and services, expanding exemptions and simplifying regulations. Specifically, the bill adds several types of health facilities and services to the list of those that do not require a certificate of need, including psychiatric hospitals, physical rehabilitation hospitals, chemical dependency programs, home health agencies, kidney disease treatment centers, and freestanding hemodialysis units. The bill also removes some previous restrictions on behavioral health services and chronic renal dialysis facilities. Additionally, the legislation modifies notification requirements for acquiring health facilities or medical equipment, making it easier for certain types of healthcare providers to establish or expand services without going through a lengthy approval process. The changes aim to reduce regulatory barriers for healthcare providers, potentially increasing access to medical services in rural and underserved areas of Kentucky. The bill includes technical amendments to ensure consistency across related statutes and will take effect on July 1, 2026, with provisions to preserve existing actions and exemptions already granted under the previous regulations.
