State Medicaid program; Ensuring Access to Medicaid Act; broadening certain definition; reimbursements; providers; pharmacists; effective date; emergency; contingent effectiveness. HB 2322 adds home care agencies and other health care providers to the list of entities required to disclose information relating to costs for the insured and various charges for care. The measure also provides that any failure of any insurer in the measure to compensate the practitioner, hospital, home care agency, ambulatory surgical center, or other health care provider if the conditions of coverage are met providing care shall be liable for damages. Additionally, such insurers shall be subject to a civil fine in an amount determined by the Insurance Commissioner. The measure provides that a pharmacy or pharmacist will receive direct reimbursement from Oklahoma Health Care Authority when providing a healthcare service to a Medicaid member at a rate no less than that of other healthcare providers for providing the same service.
