To The Extent Allowed By Federal Law, A Hospital Service Corporation Or Medical Service Corporation That Issues, Amends, Delivers Or Renews A Subscription Contract On Or After The Effective Date Of This Section Shall Provide Reimbursement Coverage To A Pharmacist At A Rate Not Less Than The Rate Provided To The Following: 1. A Physician Who Is Licensed Pursuant To Title 32, Chapter 13 Or 17. 2. A Nurse Practitioner Who Is Licensed Pursuant To Title 32, Chapter 15. 3. A Physician Assistant Who Is Licensed Pursuant To Title 32, Chapter 25.

Defines unconscionable increase to mean that an increase in the price of a prescription drug that both: (a) Is excessive and not justified by the cost of producing the drug or the cost of appropriate expansion of access to the drug to promote public health. A health care facility with more than fifty inpatient beds must make available on request or online the direct pay price for at least the fifty most used diagnosis-related group codes, if applicable, for the facility and at least the fifty most used outpatient service codes, if applicable, for the facility. The services may be identified by a common procedural terminology code or by a plain-English description.
