An Act relating to health insurance: SB 943 redefines a “bona fide association”. The measure excludes bona fide association health plans from the provisions of the Small Employer Health Insurance Reform Act and classifies such associations as considered a large group for purposes of application of the Oklahoma Insurance Code. The association health plan must meet certain requirements with respect to maintaining a nondiscriminatory policy, not excluding small businesses outside of the exceptions outlined by the measure, and delivering the health plan in a form proscribed by Section 4502 of Title 36. The plan must maintain an 80% retention rate or, failing that, correct the issue within twelve months or else be subjected to the provisions of the Small Employer Health Insurance Reform Act.
